Terms & Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the SmartBar website, mobile application, and related services (collectively, the “Service”) operated by The SmartBar Foundation (“SmartBar,” “we,” “us,” or “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Accounts and Registration

Some features require an account. You agree to provide accurate information, to keep your login credentials confidential, and to be responsible for all activity under your account. Notify us promptly of any unauthorized use.

3. Use of the Service

The SmartBar app is provided free of charge for personal, non-commercial use. You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or our systems;
  • Scrape, copy, or harvest data from the Service except as expressly permitted;
  • Interfere with, disrupt, or overload the Service or its infrastructure;
  • Reverse engineer or attempt to extract source code, except where permitted by law.

4. Donations and Memberships

The Service is free to use. You may choose to make an optional donation to support SmartBar. Donations are processed securely by our payment provider, Stripe; we do not store your full card details. Donations may be one-time or recurring. Recurring donations renew automatically for the applicable period until you cancel. Except where required by law, donations are non-refundable. By donating, you authorize the applicable charges.

5. Applications and Verified Partners

Users may apply to participate as a Coach, Ambassador, or Manufacturer. Approval is at our sole discretion, and we may request supporting documentation. Approved coaches may be listed in our public directory. We may edit, suspend, or remove any listing at any time, including where a listing no longer meets our standards.

6. User Content

You retain ownership of content you submit. By submitting content, you grant SmartBar a non-exclusive, worldwide, royalty-free license to host, display, and use that content for the purpose of operating and promoting the Service. You are responsible for your content and represent that you have the rights to share it. We may remove content that violates these Terms.

7. Intellectual Property

The Service, including its content, design, logos, and software, is owned by The SmartBar Foundation or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose.

8. Health and Nutrition Disclaimer

SmartBar provides general nutrition and wellness information, including product scores and ratings, for educational and informational purposes only. It is not medical, dietary, or professional advice and is not a substitute for consultation with a qualified healthcare professional. Always seek the advice of your physician or another qualified provider regarding a medical condition or dietary decision. Never disregard professional advice because of information provided by the Service.

9. Third-Party Services and Links

The Service relies on and may link to third-party services (such as Stripe for payments). We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their own terms.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, The SmartBar Foundation and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us, if any, in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless The SmartBar Foundation and its officers, directors, and employees from any claims or damages arising out of your use of the Service or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or to SmartBar. You may stop using the Service at any time.

14. Changes to These Terms

We may update these Terms from time to time. We will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which The SmartBar Foundation is established, without regard to conflict-of-law principles.
